Out of 445 voting representatives, 442 voted in favor (92.47%), with no opposing votes. This result underscores Vietnam's commitment to modernizing its legal framework.
Key Provisions of the Revised Chemical Law
The finalized Revised Chemical Law consists of 7 chapters and 48 articles, a reduction of 4 articles compared to the draft submitted for review on May 28, 2025.
Key amendments include:
-Decentralization with Clear Responsibilities: Clarifies the roles of ministries, agencies, and provincial People's Committees in delegated authority.
-Elimination of Investment Incentives: Removes preferential policies for chemical investments (as these are now covered under the Investment Law and Science and Technology Law).
-Digital Transformation & Database Development: Mandates the establishment of a specialized chemical database and new chemical registration to accelerate digitalization.
-Streamlined Administrative Procedures: Abolishes reporting requirements for organizations and individuals, retaining only database updates in line with Resolution No. 57-NQ/TW.
-Enhanced Chemical Control: Strengthens inspections for imports and storage services of restricted chemicals; requires entities using such chemicals to register their purposes and quantities in the database.
-Accident Response Policies: Limits accident response regulations to civilian sectors.
-Chemical Traceability: Introduces electronic invoices and product tracking to improve traceability.
-Green Chemistry Principles: Explicitly integrates green chemistry principles to support environmental protection and sustainable development.
Implementation Timeline
The Revised Chemical Law will take effect onJanuary 1, 2026. However, provisions related tochemical storage certification will be delayed untilJuly 1, 2026, to ensure necessary implementation conditions are met.
